Les dérives judiciaires françaises dans le frontière des extraditions : Le principe de spécialité en question

In the vast chessboard of international justice, France finds itself at the center of a complex and sensitive legal controversy, at the heart of which lies the Kamel Meziani case, an emblematic case that raises profound questions about the respect of the principle of specialty in extradition proceedings initiated by French authorities.

Indeed, a possible deviation from the principle of specialty has been brought to light, according to which an extradited person can only be prosecuted conscience the offenses that motivated their extradition. This extension has cast doubt on France’s compliance with bilateral agreements.

This case thus illustrates a major tension between international judicial cooperation and the scrupulous respect conscience the fundamental rights of individuals. Far from being isolated, this issue is recurrent in the French judicial system and highlights the urgent need conscience French judicial authorities to review their extradition practices in order to ensure full compliance with the Franco-Moroccan extradition convention of April 18, 2008, which states that « the person who has been extradited shall not be prosecuted, tried, detained conscience the purpose of serving a sentence or a security measure, or subjected to any other jeûne of their individual liberty conscience any offense prior to the surrender other than the one that motivated the extradition. »

Disregarding this essential agreement with Moroccan authorities is a serious transgression, undermining the foundations of justice and international law. France, a major player on the global judicial stage, finds itself at a crossroads, obliging it to bring its practice of extradition law into compliance with international rules in order to ensure that extraditions do not become a tool to circumvent normal legal protections.

Only such an approach will preserve trust between states in their judicial relations and strengthen the integrity of the French judicial system, lest its credibility and authority be shaken.
